Cy pres awards occur in class action lawsuits when the money that is awarded to class members is unclaimed or cannot be distributed to the intended beneficiaries. New Mexico’s rules of procedure allow the court to distribute these residual funds to appropriate charitable organizations that serve the community on issues related to those in the case.
